Hi, does anyone remember a topic on the forum last year about the rules on fraudulent items being sold on ebay.de now changing?- I think the seller can be prosecuted now

I can't find it

Actually, now I read it it can't be that one as the buyer is suffering....the one I thought I read was bad for the seller

the buyer, they are talking about, bought those series to resell probably and therefore ,he got "punished' as a potential seller, at least, that`s how I understand the text???

Hi Martin,

Sorry for my late reply (he has sent me a PM a few days ago). I can't really help and don't remember that thread either.

I have found two sites about fakes on the official ebay sites:

1. http://pages.ebay.de/help/policies/repl ... rfeit.html:

There it says (translated):
"It's forbidden to offer fakes and illegal replicas (e.g. faked clocks, handbags and other accessory).
If an article has the name or the emblem of a company, but was not produced form ore allowed by it, you may not offer that article on eBay."

You also find this on ebay.com: http://pages.ebay.com/help/policies/rep ... rfeit.html

2. http://pages.ebay.de/safetycenter/counterfeititems.html

This is more and less the same as on ebay.com: http://pages.ebay.co.uk/safetycentre/counterfeits.html

Sorry, that's all I have found. For ebay there don't seem to be big differences between Germany and England. :-? I didn't find any specific German law about fakes.

My post has only to do with problems with custom buying from outside EU.
Maybe it is not completely correct but is the explanation for the original URL given in this thread

and the last sentence is important
Beachten Sie bitte, auch beim Kauf eines einzigen gefälschten Artikels, welchen Sie für private Zwecke erwerben, kann geschäftlicher Verkehr vermutet werden, wenn der Absender unternehmerische Ziele mit dem Verkauf verfolgt.
This means if the suspect is given the seller will sell fakes commercially so you are also automatically criminally even as a private buyer.
But at the end you need just a good lawyer.. that's all :)
